1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of Papelito, a multiplayer word-guessing party game operated by Hard Coded LLC ("we," "our," or "us"). By accessing or using Papelito, whether as a registered user or guest, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our Service. We reserve the right to modify these Terms at any time, and your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Description of Service

Papelito is a real-time multiplayer word-guessing party game available as a web application and mobile application. The Service allows users to:

• Create or join game rooms
• Form teams with other players
• Submit words ("papelitos") for gameplay
• Participate in timed word-guessing rounds
• Compete in team-based scoring

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Eligibility and Age Requirements

You must be at least 13 years of age to use Papelito. By using the Service, you represent and warrant that:

• You are at least 13 years old
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and truthful

If you are under 18, you represent that you have obtained parental or guardian consent to use the Service. We reserve the right to verify your age and may suspend or terminate accounts that violate this requirement.

4. User Accounts

4.1 Account Registration

You may use Papelito as a guest without creating an account, but certain features may be limited. To access full features, you may create an account by:

• Providing a valid email address and creating a password
• Signing in with Google or Apple authentication

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains accurate and current

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause or notice, for any reason including violation of these Terms, fraudulent activity, or any other conduct we deem harmful to other users or the Service.

5. User-Generated Content

5.1 Content You Submit

When using Papelito, you may submit words, phrases, or other content ("User Content") including:

• Words or phrases ("papelitos") for gameplay
• Player nicknames
• Game names or descriptions
• Messages or communications within games

5.2 Content License

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, store, display, reproduce, and distribute your User Content solely for the purpose of providing and improving the Service. You retain ownership of your User Content.

5.3 Content Responsibility

You are solely responsible for all User Content you submit. You represent and warrant that your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights.

6. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Submit content that infringes intellectual property rights, privacy rights, or publicity rights
• Impersonate any person or entity or falsely state or misrepresent your affiliation
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Use automated systems (bots, scripts) to access the Service without permission
• Collect or harvest information about other users without their consent
• Transmit viruses, malware, or other harmful code
• Engage in any activity that could damage, disable, or impair the Service

We reserve the right to remove any User Content that violates these Terms and to take appropriate legal action against violators.

7. Intellectual Property

7.1 Our Rights

The Service, including its design, features, functionality, and content (excluding User Content), is owned by Hard Coded LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

7.2 Trademarks

"Papelito" and related logos are trademarks of Hard Coded LLC. You may not use our trademarks without our prior written permission.

7.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimers and Limitations of Liability

8.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Guarantees

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service is free of viruses or other harmful components
• The results obtained from using the Service will be accurate or reliable

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARD CODED LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Hard Coded LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any User Content you submit

10. Termination

10.1 Termination by You

You may stop using the Service at any time. You may request deletion of your account by contacting us at hardcoded.place@gmail.com.

10.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, for any reason including violation of these Terms, fraudulent activity, or any conduct we deem harmful to other users or the Service.

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and User Content, though some information may remain in backup systems for a limited time. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

11.2 Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of such courts.

11.3 Informal Resolution

Before filing a formal legal claim, you agree to contact us at hardcoded.place@gmail.com to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within 30 days.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

If you do not agree to the modified Terms, you must stop using the Service and may request deletion of your account.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hard Coded LLC regarding your use of the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
